On Saturday December 4th at approximately 9:00 PM, officers with the Lincolnton Police Department responded to a disturbance call on Colonial Village Drive. Officers arrived to find Joey Dean Smith, 26, had been shot. Life saving measures were not successful and Smith was pronounced dead at the scene.
Investigators determined a home invasion had occurred where two subjects entered an apartment to commit a robbery. During the robbery one suspect, Joey Smith, was shot and killed by a resident. The other robbery suspect, later identified as Khalid Poole, fled the scene.
After a thorough investigation, investigators presented the facts to the District Attorney’s Office, which determined that no charges would be filed against the resident who shot and killed Smith.
On Wednesday (Dec. 15th) detectives with the Lincolnton Police Department arrested Khalid Kristian Poole, 27, of Maiden, and his girlfriend, Jazmine Nichole Bryan, 19, of Iron Station in connection with the robbery that led to the shooting.
Khalid Kristian Poole was charged with three felony counts of Common Law Robbery. Poole was released on a $30,000 secured.
Jazmine Nichole Bryan was charged with one felony count of Obstructing Justice. She was released on a $12,000 secured bond.
Both Poole and Bryan will have a first appearance in court Thursday (Dec. 16th).
